Terms Of Enrollment (“Agreement”)

Note to client: One of the most difficult aspects to successfully growing a business is making sure you keep your proprietary information and intellectual property protected, while also balancing your culture, authenticity, and commitment to clients. Speaker Mastery™ strives to provide the greatest possible experience for all our clients and the following agreement outlines some parameters and terms of the Program.
To fully experience and gain the most benefit from the Program, you agree to the following:
Program: Speaker Mastery™ Elite (“Program”)
Duration: Evergreen access to the Speaker Mastery™ core curriculum with 90 day access to the advisory program thereafter, that begins the date of your payment.
ROI Guarantee: If, within the duration of the Program, you do not generate at least your ROI in revenue by implementing the ideas, concepts, teachings, etc. contained in Prominence, AND you have satisfied the terms of the guarantee, you can request additional time in the Program by emailing team@magiecook.com.

Payment Terms:
Payment terms will be personalized and outlined in your payment invoice.
You hereby authorize Speaker Mastery™ to collect the Program cost outlined above with the first payment being due on the date of enrollment in the Program.
Payments are due in full on the due date.
If payment fails, Client must remedy this situation and provide a valid form of payment within three (3) business days or Client may be removed from the Program
Payments may be made via credit or debit card, ACH, wire transfer, or PayPal.
Your purchase is non-refundable. We are here to advise you to your highest level of success, and part of that requires a commitment from you that you're fully invested in the program. When refunds are an option, you can have "one foot in" the work, and "one foot out" the door. It is to YOUR benefit to decide BEFORE purchasing that you are committing to the program. If you're in, you need to be 100% in, just as our team will be for you. Understand this is not a course. This is a hands-on advisory program where you’ll get insight directly on your business one-on-one and in a group setting with our team.
For all credit or debit card payments:
You hereby consent to having these charges automatically charged to your credit or debit card on the due date
Speaker Mastery™ is authorized to collect the payment due (in full) by collecting on any/all credit or debit cards that are provided to Speaker Mastery™ by the client; and
The client may determine which payment method is preferred and the client is responsible for informing Speaker Mastery™ of this preference at least two (2) business days prior to the payment due date since Speaker Mastery™’s payment system may automatically charge one of the cards on file that may not be the client’s preferred payment method.
ROI Guarantee Terms:
If, within the duration of the Program, you made less than the total purchase of this program in revenue - you may qualify for our ROI Guarantee (“Guarantee”).
In order to qualify for the Guarantee, you must have completed the following actions within the duration of the Program:
Paid the total program cost.
Completed every video/training in the Speaker Mastery™ core curriculum and submitted each applicable workbook to your accountability advisor.
Attended all advisory calls with your accountability advisor.
Participated in the daily accountability meetings for at least 60 days.
If you qualify for the Guarantee, you will be granted an additional 4 weeks of group advisory.
The 4 weeks of advisory services can be renewed indefinitely if you still haven’t made more than the total of your ROI in revenue as long as during the duration of the 4 weeks you:
Participate in the daily accountability meetings.
You can request to activate the Guarantee by emailing team@magiecook.com. You must make this request at least 1 day before your end date or the Guarantee is void.
We are committed to providing all Program participants with a positive experience. Thus, Speaker Mastery™ may, at its sole discretion, limit, suspend, or terminate your participation in any of its programs, live, recorded, social media-based or digital without refund or forgiveness of remaining payments due if you:
Become disruptive or difficult to work with
Fail to follow the Program guidelines; or
Impair the participation of our employees, contractors, clients, instructors or participants in any of our programs.
You agree with and for the benefit of Speaker Mastery™ that, during the Program and for a period of one (1) year after separation from the Program (whether such separation results from early termination or successful completion), you will not (except with the prior written consent of Speaker Mastery™), directly or indirectly, either as an individual or as a partner or joint venture or as an employee, sales representative, principal, consultant, agent, shareholder, officer or director, for any person, firm, association, organization syndicate, company or corporation, or in any other manner whatsoever, contact, solicit, or attempt to solicit any of the persons, clients, employees, companies or institutions with whom you had dealings through the Program.
For the purpose or intent of competing with Speaker Mastery™ to provide the same or similar services which Speaker Mastery™ is currently providing to any of these individuals or companies.
To leave the employ or engagement of Speaker Mastery™.
To sell or offer for sale or solicit orders for the sale of any products or services.
Note: If there is natural synergy to sell your products or services to any of the persons, clients, employees, companies or institutions with whom you had dealings through the Program- that is fine. However, we do not tolerate blatant pitching or soliciting.
We respect your privacy and must insist that you respect the privacy of fellow Program participants. We respect your confidential and proprietary information, ideas, plans and trade secrets (collectively, "Confidential Information") and must insist that you respect the same rights of fellow Program participants and of Speaker Mastery™. Thus, you agree:
Not to infringe upon any Program participant’s or Speaker Mastery™'s copyrights, patents, trademarks, trade secrets or other
That any Confidential Information shared by Program participants or any representative of Speaker Mastery™ is confidential and proprietary, and any such Confidential Information belongs solely and exclusively to the party who discloses such information;
Not to disclose such information to any other person or use it in any manner other than in discussion with other Program participants during Program sessions;
That all materials and information provided to you by Speaker Mastery™ are confidential and proprietary intellectual property which belongs solely and exclusively to Speaker Mastery™, and may only be used by you as authorized in writing by Speaker Mastery™;
Reproduction, distribution, or sale of these materials by anyone but Speaker Mastery™ is strictly prohibited; and
That if you violate, or display any likelihood of violating, any of the sections contained in this paragraph or referenced in this Agreement, Speaker Mastery™ and/or other Program participants will be entitled to injunctive relief against you for any such violations.
A breach of any of the promises or agreements contained herein will result in irreparable and continuing damage to Speaker Mastery™ for which there will be no adequate remedy at law, and Speaker Mastery™ shall be entitled to injunctive relief and/or a decree for specific performance, and such other relief as may be proper (including monetary damages, and attorney’s fees if appropriate). While you are free to discuss your individual results from this Program or any other Speaker Mastery™ program or training, you must keep the experiences and statements, oral or written, of all other participants in the strictest of confidence.
You agree that your participation is subject to Speaker Mastery™’s Privacy Policy, Terms of Service and Disclaimer (as found on the websites below) and that you agree to adhere to all terms as outlined on these websites. While we do not anticipate making frequent edits, Speaker Mastery™ reserves the right to make modifications to either of these policies at its sole discretion and without notifying Program participants.
Program education and information is intended for a general audience and does not purport to be, nor should it be construed as, advice or counseling tailored to any specific business or industry.
Content is centered around 1) identifying your niche and sculpting your message, 2) enhance your brand perceived value, 3) setting and boosting your speaker fee, 4) implement the top strategies for finding speaking events, 5) email outreach & prospecting, 6) implementing a CRM for speakers, 7) Speakers Bureau secrets & bonus learning opportunities.
All materials, procedures, policies, standards, manuals, teaching aids, and other similar tools that have been, or will be, made available by Speaker Mastery™ or its designated facilitators, or any other source, oral or written, are for individual use in or in conjunction with this training Program only.
Program content is for individual use only, and may not be sold, tape recorded, videotaped, shared, taught, given away, or otherwise divulged without the express written consent of Speaker Mastery™, or its designated agent.
The information contained in Program material is strictly for educational purposes.
Success with this Program is largely driven by your willingness to take actions as recommended by Speaker Mastery™, as it relates to the content of the Program.
If you wish to apply (or not apply) ideas, concepts, teachings, etc. contained in this material, you are taking full responsibility for your actions and furthermore you agree that your success with the Program is dependent on your willingness to follow the steps outlined by Speaker Mastery™.
Speaker Mastery™ assumes no responsibility for errors or omissions that may appear in any Program materials.
In addition to the core curriculum, as a Speaker Mastery™ Program client you will have the opportunity to utilize the following as part of the Program for the weekly duration outlined on page 1:
Accountability Advisor;
Live weekly group advisory classes;
One-on-one support with our team;
One (1) in-person or virtual live event (pay $197 to reserve your seat fee); and
Clients-only Facebook group.
You hereby agree that you have fully consented that Speaker Mastery™ is not a fully done-for- you program. Speaker Mastery™ is a group advisory program with the ability to request one-on-one support as needed in the form of guidance and council from our team. You are not guaranteed individualized support from Magie Cook all of the time.
One-on-one support is facilitated by our team through either a personalized video response or a call depending on the nature of your request. Although there is no specific one-on-one support cap, we reserve the right to limit one-on-one support if our team determines it is being abused. Common sense applies here. Please respect our team’s time and do not request one-on-one support for things that can be Googled, found within the curriculum, etc.
You agree that you are paying for evergreen access to an online course (the Speaker Mastery™ core curriculum) and limited time access (as explained in the Duration section on page 1) to our Speaker Mastery™: group advising through our live weekly classes, the ability to request one-on-one support as needed, one in-person or virtual live event (pay $197 to reserve your seat fee), access to our Private Speaker Mastery™ clients-only Facebook group and access to Ask Me Anything monthly LIVE 2HR mastermind for 1 year after the initial training & advising is complete.
Speaker Mastery™ offices are open from 9am to 5pm EST Monday to Friday. Our offices are closed during the weekends and for United States federal Holidays.
Note: Although Speaker Mastery™ does not include full done-for-you services, Magie truly cares about the success of her clients. She strives to under promise and overdeliver in everything she does. Understand it’s in our best interest to see you succeed with our material because more valuable than your purchase, is your positive testimony we hope to someday receive from you.
From time to time, Magie will have to re-schedule your weekly training calls due to her speaker travel bookings. All training calls will resume and begin at a mutually agreed date by the group’s majority vote.
You hereby agree that all Program sales are non-refundable and non-transferrable.
You agree that you have fully consented to any payment to Speaker Mastery™ and that any/all payments are valid and that you have consented to the purchase of the Program as outlined in Section 1.
You agree to waive any/all rights to charge-back, dispute, or make claims (“disputes”) against any payment made to Speaker Mastery™ as being fraudulent, purchased in error, services not delivered to you, product not received, or any other dispute which claims that any payment is unlawful.
You agree to not initiate any disputes or claims through your credit card company, bank, lending institution, or any other payment provider since you have fully consented to all charges outlined in Section 1 and thus you agree that you may not dispute any payments made to Speaker Mastery™ for the Program.
You agree that you can pause your access to the Program ONCE for up to 90-days by emailing team@magiecook.com.
All matters relating to this Agreement shall be governed by and construed in accordance with the internal laws of the State of Florida without giving effect to any choice or conflict of law provision or rule (whether of the State of Florida or any other jurisdiction).
Any legal suit, action or proceeding arising out of, or related to this Agreement shall be instituted exclusively in the state or federal district courts located in Pinellas County, Florida, and you waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
At the Company’s sole discretion, it may require you to submit any disputes arising from this Agreement, including disputes arising from or concerning its interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Florida law.
By signing below, the client agrees to the terms of this Agreement.
